Case Facts: An 85 year old Dutchess County woman agreed to settle her personal injury case for the sum of $150,000.00 at the commencement of trial. The Plaintiff alleged that she sustained an injury to her right knee as the result of a rear-end collision that occurred on Route 82 in East Fishkill, New York. The defense argued that the Plaintiff had the same knee injury prior to the accident and that the accident was not the cause of her continued disability.
